EatFree LLC ("EatFree," "we," "us," or "our") operates the EatFree mobile application and related services (collectively, the "Service"). This Privacy Policy explains how we collect, use, disclose, and protect information when you use EatFree.
We designed EatFree to help people with food allergies and dietary preferences discover restaurants and menu items. EatFree is a discovery and informational platform only. We do not verify allergen information and do not provide medical advice.
1. Information We Collect
A. Information You Provide to Us
Depending on how you use the Service, we may collect the following information:
- Account information such as name and email address (if you choose to create an account)
- Dietary preferences and allergen selections, including Top 9 allergens and vegetarian/vegan preferences
- User-generated content, such as saved favorite meals, favorite restaurants, and comments
- Communications you send to us (e.g., support requests or feedback)
You may use certain features of EatFree without creating an account. An account may be required to access features such as saving favorites, submitting comments, or syncing preferences across devices.
B. Information Collected Automatically
When you use the Service, we may automatically collect:
- Device information (such as device type, operating system, and app version)
- Usage information (such as screens viewed, features used, and interactions)
- Precise location information, if you explicitly grant permission through your device settings, used solely to display nearby restaurants while the app is in use. EatFree does not access location data in the background and does not store or retain historical location data.
EatFree uses precise location information only at the time of use and does not store or retain users' location history.
C. Information from Restaurants
EatFree features restaurants under two participation types:
EatFree Certified Restaurants
EatFree Certified restaurants independently review, confirm, and maintain their own menu and allergen information within the EatFree platform. These restaurants are responsible for the accuracy and completeness of the information they provide.
Non-EatFree Certified Restaurants
For restaurants that are not EatFree Certified, EatFree may assist by uploading and organizing menu information based on publicly available sources or information provided by the restaurant. These listings include a clearly displayed "last updated" date or month to indicate when the information was most recently reviewed or entered.
Regardless of participation type, EatFree does not independently test, audit, or scientifically verify allergen information. Users must always confirm allergen details directly with the restaurant prior to ordering or consuming food.
2. How We Use Information
We use information to:
- Operate, maintain, and improve the Service
- Personalize restaurant and menu discovery based on your preferences
- Respond to inquiries and provide customer support
- Monitor usage trends and app performance
- Protect against misuse, fraud, or security issues
- Personalize content, including featured restaurants or menu items, based on your dietary preferences and activity within EatFree
We do not use your information for behavioral advertising, cross-app tracking, or advertising attribution.
3. How We Share Information
We may share information only in the following circumstances:
A. Service Providers
We may share information with trusted third-party vendors who help us operate the Service (such as analytics or performance monitoring providers). These providers are contractually required to protect your information and use it only for authorized purposes.
B. Legal Requirements
We may disclose information if required to do so by law or if we believe disclosure is necessary to:
- Comply with legal obligations
- Protect the rights, safety, or property of EatFree, our users, or others
C. Business Transfers
If EatFree is involved in a merger, acquisition, or asset sale, information may be transferred as part of that transaction.
We do not sell personal information. EatFree does not rent, trade, or share personal information for monetary or advertising purposes.
D. Third-Party Links
The Service may contain links to third-party websites or applications, including restaurant websites or mobile apps. EatFree does not control and is not responsible for the privacy practices, content, or security of those third parties. Your interactions with third-party services are governed by their own privacy policies and terms.
4. Analytics and App Performance
EatFree uses software development kits (SDKs) for analytics and performance monitoring to understand how users interact with the Service, diagnose issues, and improve functionality and reliability. EatFree does not use analytics data to identify individual users across different apps, services, or companies.
These SDKs are used only for first-party analytics and performance purposes and are not used for advertising, cross-app tracking, or identifying users across other companies' apps or websites.
5. Data Retention
We retain information only for as long as necessary to:
- Provide the Service
- Comply with legal obligations
- Resolve disputes
- Enforce our agreements
You may request deletion of your account or personal information by contacting us. We will respond to verified deletion requests within a reasonable period, and no later than 30 days, unless a longer retention period is required by law.
6. Your Choices and Rights
Depending on your location, you may have rights to:
- Access the personal information we hold about you
- Request correction or deletion of your information
- Opt out of non-essential communications, such as newsletters, at any time by following the unsubscribe instructions included in those communications or by contacting us.
You may delete your account at any time by contacting us, after which your personal information will be deleted or anonymized in accordance with this Policy. To exercise these rights, contact us using the information below.
7. Children's Privacy
EatFree is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If we learn that a child under 13 has provided personal information through the Service, we will take steps to delete such information. EatFree does not knowingly target or market the Service to children under 13.
8. Important Disclaimers
No Medical Advice
EatFree does not provide medical, dietary, or health advice. All information provided through the Service is for general informational purposes only.
No Allergen Verification
EatFree does not guarantee that menu items are free from allergens. Users must always confirm allergen information directly with restaurants before ordering or consuming food.
9. Data Security
We take reasonable administrative, technical, and organizational measures to protect personal information. However, no system can be completely secure, and we cannot guarantee absolute security.
10. International Users
If you use EatFree outside the United States, your information may be transferred to and processed in the United States.
11. Changes to This Policy
We may update this Privacy Policy from time to time. We will update the "Last updated" date and may notify users of material changes as required by law.
